1. What are the major responsibilities of each of the three branches of the U.S. government?
The major responsibility of the legislative branch is to develop and approve policies and
laws. The major responsibility of the judicial branch is to interpret laws. The major
responsibility of the executive branch is to enforce the laws passed by congress and signed by
the president.
2. What are some of the enforcement options in U.S. environmental policy?
EPA has a wide range of enforcement options
a. warning letter identifying the violation and what must be done to correct the problem
b. direct order to cease a specific action and comply within a certain time.
c. revoke permits or modify the conditions of a permit.
d. civil enforcement—the imposition of fines,
e. criminal proceedings that can result in fines or imprisonment.
3. What role does administrative law play in U.S. environmental policy?
Most environmental policies are enforced by some part of the executive branch of government
(EPA, Dept of Energy, Nuclear Regulatory Commission, Food and Drug Administration, etc.)
which establish rules that determine how the department will enforce environmental laws.
All actions of federal agencies must comply with the 1946 Administrative Procedure Act which
requires that the public have input into the rule making process of the executive branch of the
government.
The public must be made aware of the development of new rules, or changes in the
interpretation or enforcement of a rule.
The public has the right to challenge the interpretation or method of enforcement of an
administrative rule before and administrative law judge.
4. What important environmental policy initiatives were included in the National Environmental
Policy Act?
The National Environmental Policy Act
1. Established a national policy that the quality of the environment should be protected.
2. Required all federal executive agencies to consider the environmental impacts of their
decisions.
3. Established the Council on Environmental Quality to oversee the implementation of NEPA
and develop and recommend policies concerning the environment to the president.
5. Most bills introduced in Congress never become law. List three steps in the legislative
process that could cause a bill to not become law.
1. The party leadership of either the House of Representatives or the Senate send it to a
committee that may not act on it. So it dies in committee.
2. The same thing can happen at the subcommittee level.
