Tight budgets influence the operations of criminal justice agencies. Prisons are expensive
to build and, once operational, expensive to maintain. This is especially true for facilities
designed to house the most dangerous inmate population. No matter how good the economy,
corrections rarely sees an increase in funding [ CITATION Wal18 \l 1033 ]. Conversely, when
budget cuts are required, corrections is often considered a prime source for money savings. With
increasing costs and demands on correctional systems, the state of Michigan must drastically cut
its inmate population, effective prisoner reentry initiatives are becoming necessary components
of a comprehensive public safety strategy.
Main idea. The main idea of the article is that the “state budget deficit estimated at $1.8
billion looming next year, Michigan lawmakers are looking for ways to lower spending” [
CITATION Gra \l 1033 ]. the repeal of the Truth in Sentencing law is a proposal that is being
discussed, as it enables the state to accelerate the pace of inmates being released from state
prisons. I chose this article because this article addresses a budgeting issue in the state of
Michigan.
Author’s recommendations. The author recommended repealing Michigan's Truth in
Sentencing law. According to the Michigan Department of Corrections, Truth in Sentencing is a
1998 state law which eliminates disciplinary credits, good time and corrections centers for certain
offenders and requires offenders to serve the entire minimum sentence in prison prior to being
considered for parole. It replaces disciplinary credits with "disciplinary time" which is days
accumulated for incurring Class 1 misconducts while in prison. Disciplinary time days are not to
be formally added to the minimum sentence, but the Parole Board must consider the amount of
time each prisoner has accumulated when it considers parole [ CITATION Mic \l 1033
].
If the legislation passes, 7,550 inmates could be released this year before their minimum
sentences are served. In result, the system will save $42 million this year and even more next
year [ CITATION Gra \l 1033 ]. Most inmates would have served at least 85% of their minimum
sentences before being released if their behavior while incarcerated was acceptable.
The author also recommended restoring our judges' discretionary powers, as judges are
often restricted when determining sentences for people convicted of crimes; many crimes are
subject to harsh mandatory minimum penalties. Removing mandatory minimum sentences and
giving judges greater freedom in sentencing would allow judges to use their legal knowledge and
judicial experience combined with the evidence presented at trial to weigh mitigating factors
