established America’s national government and fundamental laws, while guaranteeing certain

basic rights for its citizens. The Fourth Amendment guarantees that the people have a right to be

secure in their persons, houses, papers, and effects, against unreasonable searches and seizures.

This legal right limit the power of the police to seize and search people, their property, and their

homes. The Fourth Amendment was created to secure that the government did not use illegal

methods and or procedures to get evidence against an individual that is suspected of a crime.

Following is an executive summary regarding the common law background of the Fourth

Amendment.

Background of the Fourth Amendment

The Bill of Rights were enacted in 1789, which included the Fourth Amendment. The

principle of the Fourth Amendment is that people have the “right to be secure in their persons,

houses, papers, and effects, against unreasonable searches and seizures” (ushistory.org, 2021).

The Fourth Amendment is the foundation of criminal law jurisprudence and protects the rights of

people. It is also the responsibility of law enforcement officials to adhere too and enforce the

rights of the people. To understand the Fourth Amendment, it is important to have knowledge of

the common law background of the Fourth Amendment.

The Fourth Amendment was created because of the experiences the colonists had with the

British Crown. The King of England (King George) and Britain passed many tax and collection
