Unit 32 D2
Food Retailing

Unit 32 (D2) - Analyse the importance of legislative and
regulatory controls on food retailers.
In this task, I will be analysing the importance of legislative and regulatory controls
on food retailers Sainsbury’s and McDonald’s.

Control of substances hazardous to health (COSHH) 2002
The occupational use of nanomaterials is regulated under the Control of Substances
Hazardous to Health (COSHH). COSHH is the law that requires employers to
control substances that are hazardous to health and includes nanomaterials. Most
businesses use substances, or products that are mixtures of substances. Some
processes create substances. These could cause harm to employees and consumer.
An advantage to Sainsbury’s implementing the act is it the fact that it helps protect
people in the workplace against health risks from hazardous substances. Exposure
to dangerous chemicals has been shown to increase a person’s chances of lung
disease, skin cancer, asthma and dermatitis. By implementing the act Sainsbury’s
minimises their employee turnover in addition to their employee absences. Another
advantage is if Sainsbury’s were seen to be not abiding to the act, they could face a
million-pound lawsuit by both employees and consumers. Due to the fact that
Sainsbury’s would knowingly be putting those who shop and work inside their retail 1
outlets in potentially life-threatening danger. Substances cams include dust which is
why Sainsbury’s spends millions of pounds ensuring employees and members of the
public are safe.
A disadvantage to Sainsbury’s implementing the act is there are products which are
used to clean which could be classed as a hazard to health such as bleach.
Therefore, the business needs to spend more money ensuring the products they use
inside their retail outlets contain a safe amount of chemicals because if they don’t
they could unknowingly harm their employees and customers. Additionally,
Sainsbury’s has to spend millions a year training all their employees on substances
which are hazardous to health in addition to training them on how to do their job.
Therefore, it could be classed as an unnecessary expense when they could spend
the money on improving their products and services.
Food Safety Regulations 2005
When a business open they need to make sure food is safe to eat and make sure
you don’t add, remove or treat food in a way that makes it harmful to eat as well as
making sure the food is the same quality that you say it is, make sure you don’t
mislead people by the way food is labelled, advertised or marketed.

The advantage to Sainsbury’s implementing this act is it can help increase the
businesses share price. A link was shown previously when a well-known author
accused a large restaurant chain of giving them food poisoning on twitter the
