(P4)- Explain how organisations obtain the co-operation of their employees.
In order for there to be the maximum amount of business performance in a business, all
employees in an organisation must be able to acknowledge the fact that working together
and co-operating effectively and efficiently allows for all employees to be involved in
whatever is happening within an organisation. In this assignment, the way organisations
obtain the co-operation of their employees will be explained with detail.
Employment Contracts
All employees have contracts between themselves and their employers. This means that the
employee agrees to perform contractual tasks in return for payment, alongside extra
benefits such as contractual entitlements, rights and procedures that are associated with
the existence of employment contracts. Contractual entitlements such as the amount of pay
or sick pay allows for organisations like Monoux or Morrisons to obtain the co-operation of
their employees because the chance to receive such benefits like higher pay or sick pay will
statistically bring about employees to work together so that they can receive these benefits.
Businesses like Monoux and Morrisons do this by defining the expectations and standards of
the company so that employees can co-operate and work together effectively and efficiently
so that they can meet these standards. For instance, one expectation or standard Morrisons
may have is that they may have a high expectation of high sales, therefore employees could
co-operate together by operating the cashiers together so that they can reach the maximum
number of sales to meet the standards set by Morrisons.
Employee and Employer Rights
Both employees and employers are given the basic legal rights that they deserve to have in
a workplace. Some examples of these rights include the right to equal pay, the right to not
be discriminated against, or the right to receive pay under maternity, paternity, redundancy,
or medical leave. These rights are terms that are found in the contract between employee
and employer of a business because these terms tend to be implied terms as they are
obvious rights everyone should have; therefore it portrays the fact that the employer is
providing a safe and healthy work environment, and in return, the employer will be loyal
and hardworking. One example of an employee’s rights being exercised is the use of the
right for employees to have paid maternity/paternity leave. An employee taking maternity
leave gets paid for up to 39 weeks, with 6 of those weeks is where the employee gets paid
90% of their normal wages before tax. In terms of Morrisons, the average wage of their
workers is around £9.19 an hour. This means that Morrisons employees would get around
£8.27 as that is 90% of the average wage for all Morrison workers. This illustrates the fact
that Morrison takes care of their employees by giving them paid maternity/paternity leave,
which can constitute as medical leave. Therefore, having these legal rights and obligations
mean that employees will be able to co-operate better with each other because their rights
give them an obligation to work to the best of their ability with their colleagues in order to
maximise business performance so that their employer, the business, can remain profitable.

There are several types of employee contracts that exist between the employee and the
employer. These contracts determine the flexibility of the working schedule and the pay
wages, all of which is determinate based on the type of employment employees are
contractually obliged to follow. The main employee contract that almost everyone has with
their employer is a permanent contract. This is where the employee accepts the terms and
conditions of the contract made by the employer, such as the wages, legal rights or included
contractual benefits that can be given as part of the job, such as sick leave with pay or long
and extended breaks. There are 10 different forms of employee contracts, each with their
own upsides, for which these upsides allow employees of these contracts to co-operate
more easily so that they can obtain a common goal, which are contractual benefits. For
instance, corporations that have employees of a permanent contract may be able to obtain
the co-operation between these employees as the common factor of contractual
entitlement of benefits between the two are similar, therefore these benefits such as
extended breaks or increase in wages are all factors and reasons that contribute to workers
co-operating together. Morrisons’ contractual entitlements for their employees such as
wage increases or the maximum of 35 days’ worth of vacation break time is an incentive for
employees to work together to not only meet the standards of Morrisons, but they are co-
operating together to further increase business performance, making these incentives
worthwhile and well-deserved due to their hard work and performance.
Disciplinary Procedures
Disciplinary procedures and policies and procedures set in place to allow employees know
what would happen in the possible event in which they do something wrong that is against
the terms and conditions in their contract, known as a breach of contract. If employees do
not follow these disciplinary procedures, then they are legally obligated to have an
Employment Tribunal where unbiased people, including a legitimate judge listens to the
claims made against the employee so that it can be determined if the employee should be
fired or not. During an investigation of these claims, the employee cannot work, but they
will still get paid during this duration as it follows the minimum statutory procedure. An
example of employees not following disciplinary procedures is when an employee of
Morrisons received £7000 in maternity leave pay, however she should not have gained it
because she had falsified documents relating to her citizenship and identity in the UK,
meaning the money she gained was not allowed as the job she worked at was given to her
illegally, but unknowingly. However, since this employee was committing satisfactory work,
she was sentenced to 150 hours in community service, instead of the jail time used for fraud
charges. Overall, disciplinary charges are used by businesses like Morrisons to receive
collaboration between employees because the understood punishment of potential jail time
and sentencing can make employees follow all policies, procedures, and principals so that
they can avoid the alternate scenario, alongside the fact that they’d be able to co-operate
together in the hopes of increasing their own performance as well as business performance
so that it can be observed that the employees are hard workers and not likely to break or
disobey disciplinary procedures.
