Vonnis is niet vormvrij:
 Beslissings- en motiveringsvoorschriften (art. 358 en 359 Sv)
- Art. 358 Sv
 Dagvaarding is nietig
 Rechtbank is onbevoegd
 De officier van justitie is niet ontvankelijk in de vervolging
 De vervolging wordt geschorst
 ‘Bij het onderzoek ter terechtzitting is gebleken dat de dagvaarding geldig
is. De rechtbank is bevoegd van het ten laste gelegde kennis te nemen en
de officier van justitie kan in zijn vervolging worden ontvangen. Voorts zijn
er geen gronden gebleken voor schorsing van de vervolging.

 Overweging ten aanzien van de straf

In een vonnis de naam van slachtoffer en dader helemaal uitschrijven.
Uitstrepingen moet je eruit laten  ‘of’ bepalingen

 Art. 358 lid 1 Sv: de einduitspraak ex. art. 349 Sv
 Art. 358 lid 2 Sv: de beslissing op de materiële hoofdvragen
 Art. 358 lid 3 Sv:
- Beslissing afwijzing verweer inzake formele vragen
- Beslissing afwijzing verweer inzake 2e materiële hoofdvraag
- Beslissing afwijzing verweer inzake 3e materiële hoofdvraag
- Beslissing afwijzing strafverminderingsgrond
 Einduitspraken (art. 138 Sv) inzake de hoofdvragen op grond van art. 352 Sv worden
opgenomen (vrijspraak, OVAR (ontslag van alle rechtsvervolging)., straf of maatregel)
 Eis van justitie
 Art. 359 lid 2 Sv – motivering einduitspraak formele voorvragen
