Part 1

Patient privacy is one of the most important things we do as healthcare providers. Laws

and regulations are put in place to ensure that everyone in the medical community is following

the rules and ensuring there is no breach of information. There is never an exception to never

giving out a patient's information whether it be intentionally or unintentionally. Unfortunately,

there are still some instances where this information is not protected in the way that it should.

In one case imparticular this breach of confidentiality happened to someone that was not

only battling a terminal illness but also her privacy. Farrah Fawcett had suspected someone had

been leaking her health information to the tabloids but it wasn’t until she took matters into her

own hands and did a sting operation to get the proof she needed that someone was indeed leaking

her health information to the media. When her cancer returned she deliberately withheld the

information from everyone in her life to prove that someone was leaking the information

(ALSONFI, S. WILD, A. HAGAN, K. and IBANGA, I. 2009). A tabloid had paid an employee

almost 5 grand for the information on Fawcett just 4 days after getting the information herself.

While having to deal with such a horrible diagnosis she also had to figure out who was leaking

her information during such a trying time for her and her family. With HIPAA in place, the

liability of this case falls on the hospital in the form of a torte. Liability is the legal obligation

determined by the court and the person responsible for the tort will be responsible for any

damages, or compensation to the party affected (Melanie.2017).
