Law Commission.In order for the legal system to flourish, the law must change as society
adapts and views change.
The law commission is made up of a chairman (usually a high court judge)
and then 4 other commissioners (highly qualified lawyers) and support staff.
They do this by:
-Consolidate existing law
-Repealing old laws
-Respond to public opinion on a matter
-Closing loopholes
Reform happens in 2 ways:
1) Judicial law reform
-Use of precedent
-Adapting old decisions by potential new decisions.
2) Law commission
-Law commission 1965
-4 main roles:
1) Reform
2) Codification
3) Consolidation
4) Repeal
Reform:
LC will consider areas of law that are in need of reform, or change.
- These can come from either the government or the LC themselves.
- Lord chancellor on behalf of the government.
