1. DOUANEBELEID
1.1. Indirecte belastingen
Kenmerken:
Belastingbetaler is niet gekend bij de fiscus
Ontstaan pas op moment van transactie
≠ directe belastingen (personenbelasting, vennootschapsbelasting, onroerende voorheffing)
Belangrijkste indirecte belastingen:
BTW (belasting over de toegevoegde waarde) (Value Added Taxes (VAT))
Accijnzen (excise)
Douanerechten (customs duty)

Registratie-, hypotheek- en griffierechten
1.2. Douanebeleid gebaseerd op het principe van de douane-
unie
Douane-unie (customs union)= groep van 2 of meer landen die streven naar economische integratie
zonder beperkingen aan de interne grenzen.
Het douanebeleid van de EU of ‘de Unie’ = gebaseerd op het principe van de douane-unie
Kenmerken:
1. Gemeenschappelijke invoerrechten (in vrije verkeer)
2. Gemeenschappelijke douanewetgeving (DW, Nomenclatuur)
3. Gemeenschappelijke handelspolitiek (t.a.v. derde landen)
4. Harmonisatie van overige indirecte belastingen (BTW, accijnzen)
1.2.1. Gemeenschappelijke invoerrechten
= een gemeenschappelijk tarief voor invoerrechten dat in heel de Unie hetzelfde is voor
belasten van goederen die van buiten de EU in de EU worden ingevoerd.
Er worden geen invoerrechten geheven op goederen in vrij verkeer (free circulation) in de
douane unie;
o Goederen die binnen de douane – unie uit de primaire sector komen
o Of binnen de douane – unie in de secundaire sector ontstaan uit de goederen vd
primaire sector
o Maar ook goederen die van buiten de douane-unie in de douane-unie worden
gebracht en waarop alle invoerrechten voldaan werden, zijn in het vrije verkeer
Ook producten die uit deze goederen ontstaan
alle goederen die aan 1 van bovenstaande voorwaarden voldoen, bevinden zich in het ‘vrije
verkeer’
1.2.2. Gemeenschappelijke douanewetgeving
Alle landen van een douane-unie dienen zoveel mogelijk over dezelfde douanewetgeving (DW)
te beschikken. DW zit vervat in Uniedouanewetboek, uitvoeringsverordeningen vh
Uniedouanewetboek, de Gecombineerde Nomenclatuur,... ook in internationale verdragen.
