ART 138: HOMICIDIO 10-15 años
-Bien jurídico protegidos: todos tienen derecho a la vida, es la vida humana
independiente y extrauterina, siendo protegida la vida humana dependiente o
intrauterina por delito de aborto.
• Concepto naturalístico: cuando cumplan los presupuestos físico-
biológicos nos hallamos ante una vida merecedora de protección.
• Concepción valorativa: A la hora de determinar el alcance de protección
operan criterios valorativos.
• Concepción mixta: Entre naturalística y valorativa
-Tipo Objetivo>
• sujeto activo ( quien relaiza la acción de matar)
• sujeto paviso ( ser humano diferente al autor)
(( Quien induzcan o cooperen con suicidio ajeno art 143.1 y 2 CP, ya que el
suicidio es impune y tentativa también ))
-Límite Mínimo: Se ha de fijar el momento a partir del cual el objeto material
del delito de aborto se transforma en el propio del delito de homicidio; el
nacimiento.
-Límite Máximo: Se trata de determinar el momento a partir del cual deja de
existir el objeto material del delito de homicidio; la muerte.
-La Conducta Típica, se determina>
• comisión activa: acción produce muerte de otro
• comisión por omisión: deberá efectuarse un suicidio por equivalencia.
-Tipo Subjetivo>
• dolo directo 1 grado
• dolo directo 2 grado
• dolo eventual
Animus necandi: voluntad de matar
Animus laedendi: voluntad de lesionar
– si queriendo producir lesiones se produce la muerte de la víctima por
imprudencia sería homicidio preterintencional, se castiga con un
concurso de delitos y si quieres producir lesiones y lo consigues delito
leve de lesiones.
– Si existe animus necandi pero no se consuma homicidio, pero causa
lesiones, nos hallamos ante tentativa de homicidio. Y si se consuma el
homicidio sería homicidio doloso consumado.
– Si queremos producir animus laedendi y lo conseguimos nos hallamos
ante lesiones dolosas consumadas, pero si causamos la muerte sería
homicidio imprudente.
