BUS 206 Project Three – Tort Law
New Hampshire University

A tort is an act or omission that gives rise to injury or harm to another and amounts to a

civil wrong for which courts impose liability (Team, 2019). Tort law have been established to

provide relief to an injured parties due to harm cause, hold parties responsible, and hopefully

stop others from repeating the act.

A tort helps shift accountability from the injured part o the person actually at fault,

or possibly someone who is better suited to bear the burden of loss. Typically monetary

compensation is seeked in tort cases. Other remedies that are not as common are injunction

and restitution.

Tort law has specific boundaries defined by state statues and common law. As a Judge

they have a wide latitude in determining which actions are legally found as wrongs, which

actually are legally wrong is he larger picture. According to Cornell Law School, torts fall into

three general categories:

 Intentional tort (intentionally hitting a person)

 Negligent Torts (causing an accident by failing to obey traffic rules)

 Strict Liability (liability for making and selling a defective product)

The law acknowledges torts civil wrong doings and allows people to recover for their

losses. In a tort case if you are injured you can bring suit against the person. Typically looking

for monetary compensation or for an injunction, this should compel the agitator to stop the

activity. The Court can award damages to deter further misconduct.

The case we reviewed spoke about a snake getting out from Dave Dawgs and it slithered

into Sunshine Yoga. A frightened yoga studio owner, Jasmine subsequently had a heart attack.

This is an example of intentional tort. While Dave didn’t didn’t actually mean harm it is still

example.
