What is Unlawful Competition:
The word "unlawful competition" refers to any form of delict committed in the
field of competition. Because illegal competition is a delict, it necessitates the
presence of all of the elements that constitute a delict before action can be
taken.
1.The act or conduct:
The wrongdoer must have done something to harm the prejudiced party. As a
result, it follows that a violation of a person's rights must be accompanied by an
act, deed, or other form of behaviour. In the case in point, Buttercup Dairy
Company was harmed in some way since the company was losing customers to
Buttercup Margarine Company who was selling margarine wholesale at a
considerably reduced price.
2.Fault:
If we discover that someone has done something wrong, we judge the conduct
based on the element of fault. The term "fault" simply refers to the legal
attribution of blame for a person's actions. The injured party must be able to
blame the wrongdoer for any damages. A delict can also be defined as a fault-
worthy state of mind. In legal terms, fault can be defined as either intentional or
negligent behaviour. In some limited circumstances, blame isn't required at all,
and neither intent nor negligence are required. In the given scenario Buttercup
Margarine Company is at blame. Buttercup Margarine Company does not have
good intentions, since they are spoiling and taking Buttercup Dairy Company's
customers.
