The Miranda v Arizona ruling in 1966, law enforcement could question possible suspects without

their having legal counsel present. They could bully potential suspects, trick them, and do whatever

else they thought was necessary to determine potential suspects' involvement in a crime. The

Miranda ruling protects people by allowing them to have legal counsel present when questioned by

law enforcement regarding a crime in which they may or may not have been involved. All of this

changed behind the case Miranda v. Arizona in March of 1963, when Arizona police officers

arrested Ernesto Miranda and interrogated him for two hours without reading him his rights. The

driving purpose behind the Miranda Rights is to prevent law enforcement from forcing individuals

being interrogated to incriminate themselves. The Miranda Rights were created to help defend the

5th Amendment right against compelled self-incrimination and uphold the 6th Amendment right to

counsel. These rights are named after Ernesto Arturo Miranda, an Arizona man who was convicted

of multiple felonies based in part on his confession, one which he made without knowing that he had

the right to remain silent during his interrogation[ CITATION Her \l 1033 ]. Some examples of the

Miranda rule are the right to consult with an attorney before questioning, the right to have an

attorney present during questioning, and the right to have an attorney appointed if the suspect cannot

afford one.

Some exceptions to the Miranda rule are When questioning is necessary for public safety. When

asking standard booking questions. When the police have a jailhouse informant talking to the person.

When making a routine traffic stop for a traffic violation. The suspect is being asked questions that

are standard booking procedures. The situation involves an emergency hostage situation or

negotiation. The person is unaware that they are speaking with a police officer. The police questions
