Werkcollege 7 – Advocatuur & BeroepsethiekGastcollege.
- Het ging hem vooral om de maatschappelijke verandering, was volgens hem nodig
voor de cliënten die hij bij staat (ondernemingen). Bedrijven worden steeds meer
verantwoordelijk voor sociale responsibility. Hij vond dat de beroepsgroep daarin
mee moest gaan, met de maatschappelijke tendens. Ze moesten meer meedenken
met de corporate responsibility.
- Naar onze mening was hij niet zozeer een bemiddelde advocaat, maar dacht zeker
wel aan alle partijen. Wij denken dat het gaat om een balans, je hebt altijd wel iets
van alle types. En hangt natuurlijk ook af of je een natuurlijk persoon bij staat of een
rechtspersoon.

- Natuurlijk persoon neemt conflict mee naar huis (dus aard van de belangen). Vaak bij
rechtspersoon, financieel risico, natuurlijk persoon heel anders.
Wat is de impact? Gedragsregels
- Die hired gun zal altijd door blijven trappen ten behoeve van zijn cliënt, terwijl
bemiddelende advocaat een stapje terug zou doen.
- Waken voor onnodige kosten aan zijde wederpartij (art. 6)
Geen onderscheid in natuurlijk/rechtspersoon in de gedragsregels.
Je mag verwachten dat een rechtspersoon beter begrijpt dat jij bepaalde stappen niet wil
zetten, dan dat een natuurlijk persoon dat zal begrijpen. Want die zal denken, jij bent er toch
voor mij.
Wordt voornamelijk besproken in de literatuur.

o Dan moet je doel overeenkomen met doel van je client? Dat kan bij deze
advocaat toch niet echt? Dan zou je doel moeten hebben om schuldeisers in
deze tijd nog benadeeld worden. Maar ze hebben politiek doel: economische
impact, faillissement. Type cause laywer zie schema vorige week college.
- Impact maatschappij, in plaats van voor 1 persoon. (verschil
natuurlijk/rechtspersoon)
