Recht is veel breder dan alleen de wet.
H1.2
4 functies:
- Normatieve functie: wat goed of fout is
- Geschil-oplossende functie: of en op welke wijze iemand wordt gestraft
- Additionele functie: recht beoordeelt welke regels gelden, wanneer er geen regels gemaakt
zijn (‘wat als’-situaties) (het recht doet een aanvulling)
- Instrumentele functie: gezamenlijk afgesproken regels om chaos te voorkomen

- Privaatrecht: civiele/burgerlijk recht
Personen- en familierecht (BW H1)
Vermogensrecht (BW H3,5,6)
Deze regels zijn allemaal te vinden in het Burgerlijk Wetboek (BW)
- Ondernemingsrecht: alles wat ondernemingen en bedrijven betreft (BW H2)
Traditioneel valt dit ondernemingsrecht ook nog onder het privaatrecht.
- Burgerlijk procesrecht: privaatrechtelijk geschil tussen personen (Wetboek van Burgerlijke
Rechtsvordering =Rv)
Procederen = naar de rechter gaan om een geschil te laten beslechten
Traditioneel valt dit burgerlijk procesrecht ook nog onder het privaatrecht.
- Strafrecht: staat treedt d.m.v. het OM actief op om sancties te eisen bij overtreding van de
normen. De staat bezit hiervoor een monopolypositie.
Dit recht valt onder het publiekrecht.
- Staatsrecht: de wijze waarop het Nederlandse staatsbestel wordt vormgegeven en de invloed
die de burgers daarop kunnen uitoefenen (Grondwet)
Dit recht valt onder het publiekrecht.
- Bestuursrecht: de mogelijkheden die de overheid heeft om regulerend op te treden ten
aanzien van de maatschappij (Algemene wet bestuursrecht = AWB)
Dit recht valt onder het publiekrecht.
Wetgevers:
- Nationale wetgever: de regering en de Staten-Generaal (1 e en 2e Kamer)
- Decentrale wetgever: provinciaal en gemeentelijk niveau; dit worden geen wetten, maar
verordeningen genoemd.
- Andere instantie: worden ‘keuren’ genoemd
Rangorde tussen wetgevende organen:
- Hogere regels boven lagere regels
