1. Belastingplichtigen onderworpen aan de personenbelasting
Welke soorten inkomstenbelastingen zijn er ?

3. Belastbaar tijdperk en aanslagjaar
3.1. Algemene regel
Belastbaar tijdperk
= het jaar (of gedeelte ervan) waarin de belastingplichtige
belastbare inkomsten heeft verkregen of behaald.
In de personenbelasting valt het belastbare tijdperk in
beginsel altijd samen met kalenderjaar
Aanslagjaar
= jaar waarvoor die inkomsten aangeslagen of belast worden
In personenbelasting is het AJ in beginsel altijd = het jaar dat volgt op belastbare tijdperk
3.2. Uitzondering
Soms valt BT samen met gedeelte van KJ (= kalenderjaar)
nl. wanneer ;
- Ofwel pas na 01/01 aanwezig zijn (vb. geboorte of immigratie
tijdens KJ)
- Ofwel voor 31/12 zijn weggevallen (vb. overlijden en geen
beroepsinkomsten hebben genoten of definitief vertrek naar
het buitenland waardoor men geen rijksinwoner meer is vanaf vertrek)

3.3. Beperking van de federale voordelen in functie van de duur van het
belastbaar tijdperk
• Bijzondere regeling: Beperking van bepaalde fiscale federale voordelen ifv duur belastbaar
tijdperk
• Om andere redenen dan overlijden!
• Belastbaar tijdperk volledig kalenderjaar
, • Uitgedrukt in maanden
• Een maand = vanaf de 15e dag = volle maand
• BP moet dit in veel gevallen zelf toepassen
• Lijst voordelen: pag. 29 en art. 129 WIB92 en art. 174 WIB92
• Voorbeeld: Belastbare tijdperk start op 23 maart 2018 tot 31 december 2018. Het belastbare
tijdperk heeft een duur van 9 maanden (april -> december).
• Resultaat van de beperking afronden naar het hogere of lagere veelvoud van 10€ (naargelang
eenheid van 5€)
