AVISO DE DESPIDO DE UN TRABAJADOREs un acto por el cual un patrón da por finalizada una relación laboral con un
trabajador. Esto implica que el despido es una decisión tomada única y
exclusivamente por el patrón. La decisión pude ser injustificada (cuando no existe
ningún motivo para despedir al trabajador), o bien justificada (cuando se tienen
razones válidas y suficientes para quitar el empleo al trabajador).
Debes comunicar al trabajador su despido por escrito entregándole la denominada
carta de despido.
Tienes que preavisar al trabajador que va ser despedido con la antelación que
establezca la ley dependiendo del tipo de despido de que se trate.
Entregar al trabajador despedido el finiquito e indemnización que le corresponda.
No puedes despedir al trabajador verbalmente.
La carta de despido debe contener los siguientes datos:
Debe indicarle la intención de despedirlo.
Explicarle las causas por las que lo despides
Indicarle la fecha a partir de la cual el despido será efectivo.
Para el aviso de despido de un trabajador se debe tomar a cuenta el artículo 47º de la
Ley Federal del Trabajador.
