Adult Safeguarding
● In recent years there has been a growing
awareness that adults can be at risk from harm
from abuse exploitation or neglect
● in the UK adult protection Focuses on all
adults at risk regardless of their age or their
impairment
● In the rest of the world there is more focus on
Elder abuse than adult protection

History of adult safeguarding in NI (see slide)
● It only really emerged as a policy issue in
1996
● There have been a number of policy
developments since then with the most recent
being:
○ 2015 - About the UK Northern Ireland
Adult Safeguarding: Prevention and Protection
in Partnership Policy
○ 2016 - Mental Capacity (NI) Act

How do you identify an adult who is vulnerable?
● This has been complex issue for policymakers
● it has been to draft appropriate legislation
Adult safeguarding in Northern Ireland: current
legislative powers
● Northern Ireland does not have a specific
policy 4 adult safeguarding (unique in the UK)
○ But recently health minister Robin Swann
has announced plans to bring in a new adult
safeguarding act
● the Criminal Evidence (NI) Act 1999
○ enables particular individuals with
disability to have equal access to Justice/
Court process
○ The courts must ensure everyone is able
to have a fair and public hearingE.g. If you are a
victim with a learning disability/ dementia you
can give you evidence in chief in a video
recorded interview. this makes it so much
easier to have their voice heard

○ Article 2 - to everyone's right to life should
be protected by law
○ Article 3 no one shall be subjected to
torture or inhumane or degrading treatment or
punishment
○ Article 5 everyone has the right to liberty
and security of person
○ Article 6 everyone is entitled to a fair and
public hearing
○ Article 8 everyone has the right to respect
for his private and family life (this is a qualified
right - if an individual is at risk or a law has
been broken, the right to privacy may not be
appropriate)
○ Article 12 the right to marry

● Key point of this policy was the shift away
from ‘vulnerable adult’ towards ‘ adult at risk’ ( this
change in emphasis took the responsibility away
