Betreft: Materiele en immateriële schadevergoeding zaak Bakker
Vorige week had u mij gevraagd om advies uit te brengen over de haalbaarheid
van de verschillende verordening in de zaak Bakker. Willem Bakker is bij een
verkeersongeval om het leven gekomen, doordat een motorrijder, een ‘wheelie’
op de openbare weg maakte. De betrokken personen willen een procedure gaan
starten tegen de motorrijder ter vergoeding van de geleden schade.
De rechtsvraag die in deze zaak centraal staat is: moeten de betrokken
personen Willem, Bart, Petra, Riet Bakker en de betrokken agent vergoed
worden in hun geleden schade in de zin van artikel 6:162 BW, artikel 6:95 BW
en artikel 6:106 BW?
