Case study 2: Wellings NHS Trust, Ward 3B

Ward 3B is a female surgical ward with 32 beds in bays and two side wards for more
serious cases. Amina Patel is the ward manager and she is supported by a team of
registered nurses, nursing associates and healthcare assistants.

The keypad used to gain entrance to the ward is broken and so the doors are propped
open to save the staff having to leave their duties to let people in.
The service users come into the ward for surgical procedures, some of which are
planned, and others are emergency procedures.

Lizzy D. was admitted to the ward for a routine procedure on her left hand. The
surgery went smoothly and there were no complications. Following a visit from her
husband, Lizzy complained of pain in her hand and on examination, the nurse on duty,
noticed that it was swollen and discolored.

Lizzy stated that this had ‘suddenly happened’ and that she could not explain it. She
was given medication to reduce the swelling and the pain. Because the nurse was
busy, she did not record either the issue or the medication given to Lizzy. This
particular nurse often forgets to record medication, and Amina has spoken to her
about this on several occasions.

The following day, Lizzy’s husband again visited and following this, Lizzy complained
of the same swelling and pain in her hand. The husband had insisted on drawing the
curtains around the bed at the visit, stating that he had important mattes to discuss
with his wife. Visiting is never supervised on the ward, and staff leave people to chat.

Amina administered pain relief but didn’t’t record this. She did question Lizzy about
her hand, but Lizzy turned her face away and refused to answer.

Introduction:
In this information pack, I will be identifying the influences of different health and
safety legislations that are used within a health and social care setting and explaining
how they influence safe practice. Also, I will be exploring procedures and
responsibilities that help to maintain health and safety within a health and social care
setting.

,Employers have a duty to ensure a safe working environment for their employees.
Maintaining health and safety is essential in any area of work but especially in health
and social care where staff and service users may be at risk.

Procedures to maintain health and safety include infection control and prevention.
Infections are caused by pathogens, which are microbes that infect your body. A
contagious disease is one that is transmitted by physical contact with someone that
has that disease. An infectious disease can be transmitted by air, water and even a
mosquito. As a carer it is your responsibility vaccinations are up to date to prevent the
potential spread. If a service provider is unwell with a cold, they could expose service
users who may be frail to the disease. When working with service users it is cautious
to be hygienic.

Legislations are put in place to make sure that certain behaviors are not acceptable,
and every individual should follow these laws especially in health and social care
settings to protect those who are vulnerable. There are many legislations which
protect service users in health and social care settings. Legislations are there to make
sure that laws and policies are being upheld and there are several aims that
managements have to achieve when trying to promote these. One of these intentions
is the aim to provide care that service providers give on a long-term basis and this
way to monitor the impact of this on the clients receiving the care. This happens
through monitoring regular health services where there is an increased possibility of
identifying basic care provision problems as the inspection will be more thorough if
performed regularly. The second aim of legislation is to authorize something which is
acceptable for the care of individuals by passing laws which allows something to be
performed by health professionals in order for their clients to benefit from. If a health
professionals’ actions are not acceptable, then this can lead to a consequence for the
professional, in response to an appropriate legislation the professional has ignored.
Setting policies and procedures for service providers to achieve and follow laws allows
them to be aware of what a professional must be doing in a health and social care
setting and allowing them to be punished with the law if these aren’t followed. This
allows services to give penalties to them to discourage them from acting incorrectly
again against service users in a health and social care setting.

Legislations allow individuals to have freedom of speech as they are entitled to it and
individuals have a duty of care to uphold service users’ rights and respect them.
Legislation needs to be declared in order for individuals to benefit from it and promote
the right to disclose something. Service users must uphold a service users rights and
respect their wishes depending on their care and if this is not upheld, the legislations
are used to provide consequences.

Legislation that has been approved by a governing body identifies the need to restrict
negative actions or intentions from happening. Whether it be the restriction of what
care a health professional can provide for someone due to limited qualifications, such
as a paramedic or not being able to have an injection administered, legislations
overrule the wrongdoings of the professionals to protect the wellbeing and safety of
clients and the people caring for them.

, Statutory care relates to legislation within care provided with the legal requirements.
This is care which is provided by the NHS, social care services and education services.
Statutory means compulsory which suggests that the form of care has to be offered
and provided with the law said by the government. All services including early years,
education services and the NHS and social care services are provided by the law. This
promotes health and safety through all age groups with different types of needs and
legislations that identifies how all individual needs must be promoted under
legislations that identifies how all individuals share a need to receive general care,
whilst being individualized to suit them.

When someone decides to work within a health and social care setting there are many
laws and policies which are places in order to ensure the safety of service users and
service providers. Policies and documents that are like guidelines from the
government so people follow it, and this can be updated so people can conform to it
and laws are made by the government which are followed by every health and social
care setting, which must be followed.

Health and safety at work act 1974:

One of the safety laws in health and social care that professionals are required to
follow is the health and safety at work act. This is used by professionals in the health
and social care setting as they need to follow this in order to keep themselves and
service users safe. This is used to reduce risks which may occur un a health or social
care setting. Having this used in a care home is acceptable to move a service user
form the bed to wheelchair, this has many risks involved as the service user could get
injured, so the right equipment is needed to help the service user when moving them
around.

The health and safety at work act 1974 (HASAWA) is a piece of legislation that covers
occupational health and safety within Great Britain. Employers must ensure they
protect the ‘health, safety and welfare’ at work of all their employees, this includes
temporary staff, casual workers, self-employed, clients, visitors and the general public.
A written safety policy must be in place and employers must be educated on this. The
legislation provides guidelines for the employers to follow to ensure that their setting
is safe for everybody. The legislation states that risk assessments must be made to
identify what the risks are so that the employers are able to reduce harm.

The health and safety at work act 1974 has many influences on a care setting and the
settings practice. This legislation ensures that the setting has had a risk assessment
and that a safe working environment is maintained. Risk assessments are important
as they ‘form an integral part of an occupational health and safety management plan’.
Risk assessments help to create awareness of any hazards and risks to identify what
needs to be done to reduce these. A management plan would then be created as a
way for staff members to know what risks have been identified and how they are
being fixed. This influence that the legislation has on the setting would ensure that the
staff, service users and visitors are a lot safer when they are at the setting. After the
risk assessment have been made and the risks have been reduced, the staff would
