HOOFDSTUK 1 INLEIDING STRAFRECHTWaarom is er strafrecht?
- Bescherming van de rechtsorde
Wat is rechtsorde?
- Rust en veiligheid in de samenleving.
Waarom is wanprestatie bij koop of huur niet strafbaar?
Waarom wordt een dader gestraft?
1) Vergelding
2) Voorkómen van eigenrichting
o Zelf voor eigenrechter speler
3) Preventie
a. Generale preventie (voor het hele publiek/maatschappij)
b. Speciale preventie (voor die ene dader)
4) Resocialisatie, terugkomen in de maatschappij
Maatregel: TBS= ter beschikking stelling, gevangenis met psychologische behandeling.
- Iemand met stoornis komt hier terecht;
o Doel: iemand uit de maatschappij houden.
Strafrecht gaat over:
- Verboden en geboden gedragingen
- Handhaving (controleren) en opsporing (op zoek naar dader/verdachte)
a. Politie en justitie (OM)
- Voor de rechter verschijnen: strafproces
- Straffen en maatregelen
Legaliteitsbeginsel:
- Straf alleen op basis van de wet
- Geen terugwerkende kracht
Art. 1 Sr (en Art. 16 GW):
- ‘Geen feit is strafbaar dan uit kracht van een daaraan voorafgegane strafbepaling’.
En als er een nieuwe wet komt?
Of een wet wordt gewijzigd?
