HISTOIRE DU DROITFiche résumée de la pensée juridique de Jean-Jacques Rousseau :
Rousseau analyse l’état de nature (3 phases) :
Homme solitaire (isolé, chasse, accouplement) = l’Homme est sain,
agile et heureux.
Phase d’intéractions (sentiments, raisonnement, bonté) = l’Homme
est très heureux et se construit intellectuellement
Apparition de la technique (individualisme, inégalités, misère,
désordre, enjeux de pouvoir, guerre) = l’Homme est très
malheureux.
Selon Rousseau, l’objectif à atteindre est la 2ème phase. Pour ce faire, il
faut le « contrat social » :
Abandon des droits et biens acquis à l’état de nature
Naissance des droits du citoyen
Fin des intérêts particuliers et naissance de l’intérêt général (sous
contrainte si besoin)
