Por Tipología entenderemos el estudio de los tipos.- a manera de actividad reconoceremos los
tipos de clasificaciones de victimas elaboradas por distintos autores y tratadistas de la
victimologia.
1.2.1 MENDELSOHN
Elabora indiscutiblemente la tipología más conocida y comentada en las ciencias penales, esta se
fundamenta en la correlación de la culpabilidad entre la víctima y el criminal. La hipótesis de
base describen la existencia de la correlación inversa entre la culpabilidad del delincuente y la de
la victima, a mayor culpabilidad de uno, menor culpabilidad del otro. La segunda parte de la
hipótesis es que la relación entre criminal y víctima tiene siempre un origen biopsicosocial en la
personalidad de la víctima. La clasificación la esquematiza de la siguiente forma:
1. Víctima completamente inocente, es decir la víctima inconsciente.
2. Víctima de culpabilidad menor-víctima por ignorancia, por ejemplo: la mujer que se provoca
un aborto y pierde la vida.
3. Víctima tan culpable como el infractor-víctima voluntaria:
A) Aquellos que cometen suicidio tirándolo a la suerte.
B) Suicidio por adhesión:
a) Eutanasia.
b) La pareja que pacta suicidio.
4. La víctima más culpable que el infractor:
A) Víctima provocadora, incita al infractor a cometer la infracción.
B) Víctima por imprudencia que determina el accidente por falta de control en sí mismo.
5. Víctima más culpable o únicamente culpable:
A) Víctima infractora: se trata del caso de legítima defensa.
B) Víctima simuladora: el acusador que premeditada o intencionalmente culpa al acusado.
C) Víctima imaginaria: es decir el paranoico, histórico, mitómano, senil, infantil o adolescente.
Concluye Mendelsohn que, basándose siempre en las correlaciones de culpabilidad, las victimas
pueden ser clasificadas en tres grandes grupos para efectos de la aplicación de la pena al
infractor:
