1.1 N.J.H. Huls, Wat is rechtssociologie?
Dit hoofdstuk (met enkele weglatingen) is afkomstig uit de inleiding in de rechtssociologie ‘Actie en
reactie’, geschreven door Nick Huls. Het is een tamelijk neutrale en objectieve inleiding die
normatieve, waarderende uitspraken zo veel mogelijk vermijdt. De concepten, uitgangspunten en
voorbeelden die Huls introduceert, behoren tot de standaarduitrusting van elke rechtssocioloog. Dat
zal ook blijken in de rest van de cursus. Het originele artikel over semi autonomous social fields is 1.8
uit de Reader, en het artikel over one shotters en repeat players is 2.4. Verschillende onderdelen komen
dus uitgebreid terug. Dit is een inleidende tekst om de discipline te ‘plaatsen’.


1. Leg uit op welke manier juristen en op welke manier rechtssociologen in vonnissen zijn
geïnteresseerd. Doe dat zodanig dat het onderscheid tussen law in the books en law in action duidelijk
wordt (door Huls tamelijk stellig onderscheiden).
Rechtssociologie bestudeert de wederzijdse beïnvloeding van recht en samenleving.


Law in the books: Juristen proberen een juridische puzzel op te lossen, doormiddel van het
raadplegen van de wettekst, Nederlandse jurisprudentie of de memorie van
toelichting. (wetsteksten/vonnissen/ argumenten)


Law in action: Rechtssociologen concentreren zich meer op de “law in action”. Zij
hebben niet zozeer belangstelling voor de juridische casus maar juist voor de
maatschappelijke context van het geschil.
(Totstandkoming recht/effecten/praktijk/ functioneren instituties)


Rechtssociologen bestuderen primair het functioneren van juridische
instituties en de structuren van het recht. Zij zijn geïnteresseerd in wat er
gebeurt tussen partijen voordat zij hun geschil uitvechten in een
rechtszaal.
