Hoofdrolspelers in het verbintenissenrecht. Natuurlijke personen en rechtspersonen zijn
gelijk volgens de wet.
Verbintenis: een verbintenis is een rechtsrelatie tussen twee personen. Wanneer er
een rechtsrelatie bestaat, vloeien hier verbintenissen uit voort.
De wet geeft geen definitie van het begrip, 6:1 BW bepaalt dat een verbintenis alleen kan
ontstaan als deze uit de wet voortvloeit, er moet dus een wettelijke grondslag zijn.
Een verbintenis ontstaat uit de bronnen:
1) Overeenkomst
Een meerzijdige rechtshandeling
2) Onrechtmatige daad
Een onrechtmatige daad is een inbreuk op een recht van een ander, alsook het
handelen of nalaten in strijd met een wettelijke plicht of in strijd met maatschappelijke
normen, waardoor een ander schade leidt 6:612 BW. Er is dus een verplichting om de
schade te vergoeden.
3) Andere.
- Zaakwaarneming: het behartigen van de belangen van een ander
- Onverschuldigde betaling, een prestatie die zonder rechtsgrond heeft
plaatsgevonden
- Onrechtvaardige verrijking: verrijking ten koste van een ander zonder
rechtsgrond.
