P1- Explain the implications of a duty of care in a selected health or social
care setting
Legal obligation-
Professionals have the legal obligation that professionals have to protect service users'
wellbeing and prevent harm. They have to always act in the best interest for the service user
and those who may be affected by their actions. They should act within their competence
level. Between the health professional and the patient there should be a set relationship
boundary. This is because it is important understanding that professional relationship has
boundaries which is different to relationship to family and friends. It is important there is
professional detachment so that professionals don’t become emotionally involved with their
patients. For example, in an adult health and social care setting such as elderly nursing
home it is important that there is the correct number of staff there and not below the legal
limit. This is because if something goes wrong there should be the correct number of staff to
help with the issues. In the mid Staffordshire report nurses should have more training doing
their job of looking after their patients. Their training should include testing on how to care
for individuals before they start their job. Each patient should've had one main nurse to care
for them but due to the lack of nurses and staff that are trained this was not provided for
each patient. Furthermore, the managers in the Mid Staffordshire hospital should've made
sure that the hospital is a nice place to stay at for the patients and that they are all cared for
properly and providing them the support they needed. They also should've ensured that the
hospital is a nice place to work at and that doctors and nurse isn't afraid to speak about any
problems or say their views. Another example but in a child health and social care setting is
for example in children hospital. It is important that staff log incidents and if they don’t then
it is poor practice. It is important that incidents are reported to ensure the safety of
children. For example, in baby p case the social worker missed the injuries on baby Ps face.
Which was deliberately smeared on his face with chocolate to hide them. Baby Ps life
could've been saved if it wasn’t for this poor observation of missing the bruises on his face.
Furthermore, the full examination should've been done and not have been delayed because
the baby is miserable and cranky because the doctor was trying to avoid doing his work.
After seeing the bruises on baby Ps body theses signs should've been reported before it
could've become a more serious issue and causing baby Ps death.
Uphold the rights of vulnerable people-
Professionals uphold the right of vulnerable people and promote the interests if individuals
experiencing abuse or neglect. In a health care setting many service users trust health
professionals to act as an advocate for vulnerable service users. This is to ensure that they
are treated with dignity and fairly. Vulnerable individuals may feel like they aren't able to
ask for what they need as they may be scared or even intermediated by an individual next
to them or even from members of staff. Health professionals should always consider how
disrespectful remarks can have an impact on individuals' esteem which will slow down their
recovery. Some service users do not have the capacity to be able to protect their rights due

to the lack of mental capacity and it is harder for them to understand their actions and
circumstances. Health professionals must always consider how disrespectful actions and
remarks can impact service users' self-esteem. They must always work on the principle of
that the service user is always telling the truth and you mustn't tell them that they are
wrong or judge them. For example, in an adult health and social care setting if there is an
individual always complaining about something or is a change of personality it is important
that health professionals are able to identify it. An example of this is the winterbourne view
when concerns were raised but failed to directly respond. Senior members raised concerns
about the care with the management of the hospital however due to failures to stick to
correct procedures actions wasn’t taken further which led the bad treatment to their
vulnerable patients to continue. An example of the uphold rights of vulnerable people in a
child health and social care setting is baby p case. The child is only 17 months and therefore
counts as someone vulnerable, they didn’t take his case seriously for example when the
social worker visited him and seen chocolate smeared on them, she should've wiped him
and therefore she will have seen the bruises. It is important for them to do that as baby is
just a baby and is unable to express himself.
Safe practice-
All health professionals are in a position of trust to all the service user's health and safety
wellbeing. This is because some service users may be vulnerable and have therefore health
professionals have to take responsibility for the unequal distribution of powers. This is to
ensure that service users aren't exploited, treated unfairly or intimidated. It is also
important that health professionals are able to explain their actions and how they are fair,
safe, proportionate, considered and warranted. It is important that health professionals
take care of themselves and others that are in their care. Health professionals must follow
and practice the safe workplace set by the organisation. This is for the benefits of yourself,
employing organisation, service users, and everyone else in the health professionals working
environment. If safe practice isn't observed it can lead to major issues and accidents which
can cause irreversible damage and it can be painful. For example, it can cause injuries to
individuals and will have to be investigated which is costly on both terms of damaged
confidence, health, time and money. Every work environment presents hazard but this
varies on service user's home. For example, some may have additional problems such as
thick carpets and large furniture. This will cause a problem while trying to use certain
equipment's such as a hoist. It's also important that health professionals also consider other
environmental obstacles before starting a task with the service user. The care quality
commission (CQC) ensures that health and safety training should be the care workplace
induction. Training is important as ensures that practices are safe which is why should
attend your work training. After the training it will ensure that you have a working
knowledge of, the fundamental health and safety procedures of the workplace. To promote
and practice safe working procedures health professionals should promote a culture of safe
practice and maintain a high standard of care for yourself and others. Professional
development (PD) includes reflective practices. This includes questions like ‘did I use the

right health and safety measures and how could I improve?’ it is important that you share
your skills and understanding and take advice from other people's experiences. It is
important for you to use constructive criticism to improve your professional practice. The
code of conduct is a framework which is used to work to and tells you how to behave and
interact with others to improve the service quality. It also ensures that you are effective in
what you do to ensure the yours and others safety. Code of conduct sets the standards for
your profession and gives individuals the idea of an indication of how to know when
standards aren't meet. Balancing the rights of users and managing risk can be interpreted
differently. Healthcare professionals have the power of individuals in the care that service
users that can find it difficult to challenge. Therefore, service users tend to fear losing their
independence and this can cause conflict between them and the health professionals.
Service users can accept or reject any of the treatment that is being offered to them. When
working in care it is important to act in an individual best interest. So, you might think that
you can make a better choice for the service users then you can only change it if you have
their consent and also have evidence that the individual lacks the capacity to make
decisions. An example of this is the Staffordshire hospitals because there was failure in
looking after their patients and there was shortage of staff causing for some patients not to
have quick treatment this caused un safe practice. There was also untrained staff working
there which could've caused more issues so it is important that only trained workers are
working and that there was the right number of staff at all times. The health professionals
did safe practice for Aysha king case they followed all the practices that was set by the
hospital to ensure that he had safe practice. They made sure that he wasn’t impacted by
their actions and denied the parents from taking him to get another treatment because
their hospital didn’t allow them to do so.

Rights and risks can be interpreted differently because we live in a multicultural society. An
individual's choice will usually have effects on other individuals because we don’t live in
isolation and this can affect them positively or negatively. Health professionals can have the
power of those in their care that service users find hard and difficult to challenge. Service
users are scared of losing their independence, this can cause conflict with the health care
professionals, family and friends who feel that the service user can't cope with independent
living. However, the service users do have the right to accept or decline any of the
treatment that is offered to them. It is important that you think of the service user as an
individual before examining duty of care and the procedures and polices it involves. Service
users can make their own choices even if it includes a small amount of risk.
