Nun ist zu prüfen, ob dieses Grundrecht durch eine hoheitliche Maßnahme eingeschränkt
werden könnte.
Mit Verweis auf die Schrankentrias gewährt das Grundgesetz die allgemeine
Handlungsfreiheit nur insoweit, wie nicht gegen Rechte anderer, die verfassungsgemäße
Ordnung oder das Sittengesetz verstoßen wird. Die verfassungsgemäße Ordnung hat dabei
eine ausschlaggebende Bedeutung.
Somit befindet sich im Art. 2 Abs. 1 GG eine Schranke in Form eines einfachen
Gesetzesvorbehalt und die Einschränkung des Grundrechts durch eine hoheitliche Maßnahme
kann bejaht werden.
Somit benötigt man nach dem Rechtsstaatsprinzip, gemäß Artikel 20 Abs. 3 GG eine
Ermächtigungsgrundlage die später subsumiert wird.
