opvoeding.
• Het gaat niet om sancties, maar jeugdbeschermingsmaatregelen. Bescherming is nog steeds de
grondslag van jeugdrecht
• Heel wat interventies van JR die meer gericht zijn op hestel van schade, sanctionerende
aspecten, .
• In basis betreft het nog steeds beschermingsmaatregel.
• Deze zijn toekomstgericht, alleen zo kan de jongere heropgevoed worden en kan hij geen feiten
meer plegen in de toekomst
• Geen gradatie in maatregel: voor ernstige feiten is er niet meteen een vaste maatregel. De
maatregel moet aangepast zijn aan de persoon en zijn leefmilieu.
• In de praktijk stellen we vast dat JR en parketmagistraten wel ook rekening gaan houden met de
ernst van de feiten.
• In 2006 zijn een aantal zaken ingevoerd die wel gaan zorgen voor gradaties
