EU Citizenship

People not regarded as EU citizens until TEU 1993. Provisions now form Art 18-25 TFEU.

Art.20(1): Citizenship of the Union is hereby established. Every person holding the nationality of a Member State
shall be a citizen of the Union. Citizenship of the Union shall be additional to and not replace national citizenship.

- Anyone with citizenship of member state therefore EU citizen. Nationality is conferred purely by national
law of state concerned.
- Dual nationality then can be either, even if not born in EU (Micheletti 1992)

Art.21(1): every citizen can reside freely within member states subject to treaties.

Art.18(1): Within the scope of application of the Treaties, and without prejudice to any special provisions

2001). But needs to be interpreted as not always benefits count eg can claim student loan Bidar 2005 or student
grant Forster 2008. But in Forster 2008 held that 5 year wait to claim grant is proportionate as shows integration
into society.

Even if it discriminates against own people (Tas-Hagen 2006): Dutch moved abroad and were stopped claiming

expiring when citizen family member leaves or max 5 years.
- Art.12 If death of EU citizen, family members not automatically lose right if eg in fulltime education and
can satisfy Art.7(1). For non-EU citizens, must have been resident for at least 1 year before death.
- Art.13 Same for divorce, ie must satisfy Art.7.
- Art.14 Retention of rights ie Art.6 right as long as not burden on social assistance (not automatic of
claiming though)-subjective.
- Art.16 Permanent residence if continuous stay of 5 years. For family members, 5 years alongside citizen.
Art.16(3) Continuity not affected by eg stays away under 6 months, compulsory military service, illness
etc.
