1.1.1 The South African Schools Act (No. 84 of 1996) states that with suspension
and expulsion the governing body may suspend a learner from the school, after a fair
hearing but in the case of the grade 7 learner, the principal immediately called for a
disciplinary hearing between the teacher, the learner, and the principal and did not
call the school governing body and also the principal forgot that a learner may be
expelled only by the Head of the Education Department for serious misconduct after
being assessed at a fair hearing, then after being found guilty then the Head of
Department must make an alternative arrangement for the learner’s placement at
another public school. Not the principal contacting the learner’s mother to inform her
of the decision
