College 1 inleiding strafuitsluitingsgronden
wetgever heeft geen onderscheid tussen schuld en rechtvaardigingsgronden gemaakt, want er
stond alleen “hij die” , dus alleen schulduitsluitingsschulden
wij hebben wel onderscheid gemaakt , door de hoge raad met andere consequenties
, rechtvaardigingsgronden: gedrag dat je dan mag doen
schulduitsluitingsgronden; gaan over de psysche, gedachtes van verdachte
college 3; ontoerekeningsvatbaarheid & overmacht
art. 39 ontoerekeningsvatbaarheid; ze moeten wel weten wat ze doen.
Er moet voldoen aan de volgende 3 (wettelijke) eisen
- Er moet sprake zijn van een gebrekkige ontwikkeling of ziekelijke stoornis der
geestvermogens
- Het strafbare feit moet daarvan een uitvloeisel zijn ( causaal verband)
- Daarom kan het feit verdachte niet worden toegerekend
Art. 40 overmacht
‘ door overmacht gedrongen’
rechtvaardigingsgrond; of schulduitsluitingsgrond?
overmacht; niks anders kunnen, maar ook niet hoeven handelen.
Dit kan zich voordoen bij een concrete situatie van nood (rechtvaardiging) of een kracht,
drang of dwang waartegen redelijkerwijs geen weerstand geboden kan en hoeft te worden
(psychisch oftewel schulduitsluiting)
