Learner statement Assessment
Criteria Met
Learner to provide narrative under each statement of how they meet the criteria. However, where the
assessment criteria asks you to ‘Demonstrate’ this may be covered during your observation with your
assessor and if so you are not required to provide written narrative. This will be stated under the
assessment criteria so please read carefully.

You must provide answers to each question that allow your assessor to properly assess what work duties
you are doing or what role you have within your work. It expected that you will need approximately 300
words per question. The more detail you provide the less likely your account will be sent back for more
clarification.

You must answer each question in your own words and write in the first person meaning “I do this”. A tip is
always to keep in mind the “who, why, how, where and when” in each answer.
Learning Outcome 1: Understand the implications of duty of care

1.1 Define the term ‘duty of care’

Duty of care is the moral or legal obligation to ensure the safety of others.

This means I need to be always acting withing my levels of competence, not doing anything or
neglecting to do something that may harm an individual and always acting in the best
interests of the individuals I care for.

, 1.2 Describe how duty of care relates to duty of candour
Duty of candour is one of the Care Quality Commission’s fundamental principles.

It means that care providers must be open and transparent about the care and treatment
they provide to individuals and if something goes wrong, they apologise, explain what
happened and provide support to rectify it or reduce the impact of it.

Difference between duty of care and duty of candour:

The difference between duty of care and duty of candour is that duty of care is the obligation
to act in the best interests of the individual and duty of candour is the obligation to keep the
individual fully informed about the care, even when things go wrong.

The relationship is that they are both duties or obligations to ensure the best possible
outcomes for the individuals that one cares for.

1.2 Describe how the duty of care affects own work role
Duty of care affects one’s own work role in several ways.

Firstly, it is my legal duty to look out for the welfare of the individuals that I care for and I
could be breaking the law even if I do nothing.

Therefore, any unsafe practices I encounter should be reported immediately to the relevant
person(s), following my organisation’s agreed ways of working. In most cases, this might be
