P2 Unit 3

There are a few limitations and constraints on the market activities for example the consumer law,
sale of good act, consumer protection from unfair trading regulations, consumer protection, data
protection act.

Consumer law

Businesses need to make sure that their marketing activities are within the constrainst of the law.
The European Union has strengthened consumer protection law in recent years, and businesses must
keep up to date with changes in the law and landmark rulings that might make their activities illegal.

Sale of goods act

This act requires traders to sell goods that are as they are described and of satisfactory quality. This
directly affects marketing activity because it means that any marketing should describe the product
accurately and able to substantiate any claims.

Consumer protection from unfair trading regulations

Distance selling is any form of selling where there is no face-to-facecontact between de consumer
and the business, for example an e-commerce website or a mail order catalogus. The regulations
require the business provide clear information about their purchases. The business has to give the
information about the business it selfs, the goods or sevices they selling, payment and arranges,
delivery arranges and the rights that the customer have when they cancel the order.

Data protection act

The data protection Act is designed to protect customers from unfair use of their personal
information. This act impacts on any business that keeps a database of customer information, so is
very important for any marketing department that sends out directly mail. The information in the
database must be obtained fairly and lawfully, used only for the purpose stated during collection, not
kept for longer than necessary.

Audi and Coca Cola has to deal with this laws. For example when coca cola did market research, they
can’t publish the results and names of the persons who did the test. And another law is that coca
cola has to show the ingredients inside the bottle. This are examples of data protection and
consumer laws.

When you buy a car from Audi, they has to show the rights you have when you cancel you purchase,
this is an example of Consumer protection unfair trading regulations.
