Is het een A-orgaan? → lid 1 sub a
A. Orgaan met een zelfstandige taak en functie (binnen de rechtspersoon krachtens publiekrecht)
A. Een voldoende zelfstandige positie, de zelfstandige positie moet blijken uit:
1. publiekrechtelijke bevoegdheden → moeten blijken uit de wet
2. wettelijke taak
3. systeem van de wet
B. Behorend bij een rechtspersoon krachtens publiekrecht
A. Rechtspersonen → art. 2:1 BW
4. Lid 1: Staat, provincie, gemeente of waterschap
5. Lid 2: andere rechtspersonen krachtens publiekrecht bij formele wet
B. Krachtens publiekrecht → wordt in het leven geroepen door een wet in formele zin (wetsduiding)
→ niet voldaan aan B → dan naar stap 2

Is het een B-orgaan? → lid 1 sub b
A. Persoon of college (bestuur van) privaatrechtelijke rechtspersoon
B. Met enig openbaar gezag = bij wet toegekende publiekrechtelijke bevoegdheden
A. Het college of persoon moet gezag uitoefenen → rechtsbetrekkingen eenzijdig kunnen wijzigen (publiekrechtelijke bevoegdheden uit kunnen
oefenen)
→ wel voldaan aan A, maar niet aan B → naar stap 3
Stap 3
Nagaan of er sprake is van openbaar gezag op grond van een publieke taak → een publieke taak kan ook als openbaar gezag gelden → lid 1 sub b
A. Doen van geldelijke uitkeringen/op geld waardeerbare voorzieningen (= de publieke taak)
A. Inhoudelijke band met A-orgaan → één of meer A-organen hebben beslissende invloed op bestedingscriteria
B. EN financieel band met A-orgaan → verstrekking uitkeringen wordt in overwegende mate gefinancierd door A-organen (2/3 of meer)
→ Indien antwoord op A en B “ja” is dan is er sprake van een publieke taak → dus openbaar gezag → dus een B-orgaan.
