Week 1 — Stelsel rechtsbescherming / Bevoegdheidbestuursrechter
Algemene bestuursrechtspraak → hoofdstuk 8 Awb
• Absolute competentie: in beginsel bestuursrechter bij de rechtbank (8:6)
• Relatieve competentie: zie art. 8:7 en 8:8 Awb
Hoger beroep
• De Afdeling Bestuursrechtspraak → hoogste algemene bestuursrechter (8:105 Awb)
• De Centrale Raad van Beroep → hoogste rechter in socialeverzekerings- en ambtenarenzaken
• Het College van Beroep voor het bedrijfsleven → hoogste rechter in het economisch
bestuursrecht
Voordat een beroep op de bestuursrechter gedaan kan worden, moet eerst bezwaar gemaakt
worden (art. 7:1 Awb)
Uitgangspunt is dat beroep bij de rechtbank en hoger beroep bij de ABRvS plaatsvindt,
uitzonderingen hierop zijn te vinden in Bevoegdheidsregeling bestuursrechtspraak (Brbr) en
wettelijke voorschriften (art. 8:6 Awb).
Rechtsgang stappenplan
Stap 1: beroep mogelijk? → art. 8:1 en 8:3/8:4/8:5/1:6/6:3
• Waar moet beroep ingesteld worden (absolute competentie)? → art. 8:6:
rechtbank, tenzij Bevoegdheidsregeling bestuursrechtspraak of wettelijk voorschrift (bijzondere
wet)
• Relatieve competentie → art. 8:7 (lid 1, 2 en 3 aflopen)
Stap 2: moet bezwaar gemaakt worden? → art. 7:1 → in principe wel, tenzij uitzonderingen (7:1 lid
1 sub a-g; bij g zie ook Regeling rechtstreeks beroep)
Stap 3: hoger beroep mogelijk? → 8:104: bij uitspraken v/d rechtbank of lid 2/3/4
• Waar hoger beroep? → 8:105: ABRvS, tenzij Brbr
- Indien het evident is dat het bezwaar- of beroepschrift naar de verkeerde rechter is gestuurd,
dient deze rechter het schrift door te sturen naar de bevoegde rechter (art. 6:15)
- Rechtsmiddelenclausule → art. 3:45 en 6:23 Awb
