TEMA 2: EL MATRIMONIO EN ROMAEl matrimonio romano existia mucho antes de la fundación de la ciudad y era
una de las tres instituciones anteriores a la formación de la civitas, como eran:
1. Tribus
2. Gentilidades
3. Matrimonio
El matrimonio es una sociedad de dos y desde sus origenes presentaban unas
normas de comportamiento.
El Derecho Romano acogió al matrimonio tal y como lo encontró y vnculo a esa
relación unos efectos juridicos sin alterarla, como es la filiación o las
relaciones patrimoniales y la dote.
De esta institución romana derivan unas consecuencias jurídicas que vienen a
ser la alimentacion o el auxilio por parte de ambos conyúges de manera
reciproca.
El matrimonio ha sido definido de diversas maneras a lo largo del tiempo pero
en las fuentes del derecho romano encontramos definiciones como la de
Modestino del siglo III,considerado el último jurista clásico y que decía ''El
matrimonio es la unión de un hombre y una mujer para toda la vida con
comunicación de las cosas divinas y humanas''.
El matrimonio romano es muy peculiar y distinto al de el mundo antiguo y el
moderno.
