TEMA 7 LA POSESIÓNEn la perspectiva de los juristas romanos, la posesión no es considerada un derecho
sino una situación de ventaja jurídicamente relevante. La posesión no está tutelada
mediante acciones, sino sólo a través de interdictos.
El fundamente la posesión implica una contradicción. Si la posesión es unn siimple
hecho que comporta el ejercicio de un derecho y éste puede no corresponder a quien
lo ejerce ¿por que, jurídicamente , se protege?
Para Savigny obliga a quien pretende atacar tal situación a usar la vía judicial y
demostrar su derecho.
Para Ihering la posesión es la manera más ostensible de exteriorizar la propiedad
también, protegiendo a los dueños y se evita constantemente, aportando los títulos
que demuestren su condición.
También en cuanto a su origen discrepa la doctrina:
Para Savigny la posesión esta representada por los poseedores del ager publicus.
Para Ihering el punto de partida está en la atribución interina de la cosa que el
magistrado realizaba en favor de uno de los litigantes mientras se dilucidaba quien era
su propietario
ADQUISICIÓN DE LA POSESIÓN
La posesión requiere dos elementos: el corpus y el animus, por ello, el concurso de
ambos será causa necesaria para su adquisición.
El animus ha de ser nuestro pero el corpus puede tenerlo otro.
El elemento del corpus pasa de una idea material , a otra cada vez más flexible y
espiritual sobre todo en casos de adquisición derivativa, es decir, cuando la tenencia
de la cosa proviene de su entrega.
