Algemeen stappenplan bij erkenning en tenuitvoerlegging:
1) Is de Brussel I bis-Verordening van toepassing? zo nee,
2) Is een ander verdrag van toepassing, zoals het Haags Forumkeuze Verdrag of het
Verdrag van Lugano? zo nee,
3) Commuun ipr.
Brussel I bis-Verordening:
Formeel toepassingsgebied (“ftg”) is anders dan bij de bevoegdheidsregels, namelijk
“een in een lidstaat gegeven beslissing” is vereist om te voldoen aan het ftg (ex art.
36 lid 1 Brussel I bis).
Art. 36 lid 1 Brussel I bis: “Een in een lidstaat gegeven beslissing wordt in de overage
lidstaten erkend zonder vorm van proces” automatische erkenning.
Art. 39: “Een in een lidstaat gegeven beslissing die in die lidstaat uitvoerbaar is, is in
andere lidstaten uitvoerbaar zonder dat een verklaring van uitvoerbaarheid is vereist.

Dus geen verklaring uitvoerbaarheid nodig (art. 39) Wat dan wel?
o Betekening certificaat (ex art. 43).
o Verstrekken stukken aan bevoegde NL autoriteit (ex art. 42).
Weigeringsgronden voor erkenning en tenuitvoerlegging staan in art. 45 Brussel I bis.
Openbare orde exceptie: Krombach-arrest:
Bevoegdheid mag niet worden getoetst.
R.o. 22-23 en r.o. 37.
Inhoud en openbare orde begrip aan lidstaten overgelaten, maar grenzen bewaakt
door HvJ.
Dus Franse beslissing mag niet in DU ten uitvoer worden gelegd.
Diageo Brans-arrest:
Foute toepassing/uitleg Europese/merkenrecht; geen strijd met openbare orde.
Uitputtingsregel: verplicht gebruik maken van nationale rechtsmiddelen (deze
moeten zijn uitgeput), “behoudens bijzondere omstandigheden die het te moeilijk of
onmogelijk maken”.
o Het feit dat het niet heel veel zin heeft, volstaat niet om hier onder uit te
komen. “Het aanwenden van deze rechtsmiddelen zinloos was” geen
bijzondere omstandigheid. Ontslaat de persoon niet van het aanwenden van
alle beschikbare rechtsmiddelen.
o Bij verstek staat het al in de bepaling.
o Maar bij openbare orde niet. Dus dat heeft het HvJ EU nu dus ook toegepast.
Ander verdrag van toepassing:
Kijk in dat verdrag voor de regels van erkenning en tenuitvoerlegging.
