La constitución define a España como un estado social, esto nace de
un presupuesto en que el estado era poco intervencionista pero el
estado es necesario que intervenga.
Si la sociedad por si misma no se preocupa predeterminadas
cuestiones los que se preocupan por ellos son los representantes de
los ciudadanos.
Hay intereses generales que en eta materia han de ser tenidos en
cuenta.
LA INCIDENCIA DE LA CE EN EL URBANISMO Y LA ORDENACION
DEL TERRITORIO
Hasta dónde llega la función social de la propiedad? Hasta donde el
legislador determine.
La constitución ni hace ni tiene por qué definir los conceptos que usa,
pero lo que si hace es precisar jurídicamente en si distinción.
Distingue conceptualmente que son materias distintas la ordenación
del territorio, el urbanismo, y la vivienda.
La constitución reconoce que las tres cuestiones tienen que ver con la
intervención publica, una de las precisiones sobre los principios
rectores es que tienen que ser tenidos en cuenta esas precisiones de
distinción de conceptos. El hecho de que no sean libertades públicas
no significa que no tengan que ser tenidos en cuenta.
Estas materias tienen que tener controles de calidad porque han de
ser tenidos en cuenta para ello los art. 45-46-47 CE.
En el art. 33 se reconoce el derecho ala propiedad privada y la
función social que delimitara su contenido de acuerdo con las leyes.
La función social es importante por si mismo porque denota un estado
al que le importa la sociedad. Esta frase de eliminar el contenido por
la función social lo que hace es que la ley asume el derrotero
urbanístico de la ley anterior. Los interese de incidencia de las
operaciones en su conjunto justifica la intervención pública.
Las leyes son las que regulan la materia y el sistema urbanístico, es
decir, la intervención publica sobre el suelo tiene carta normativa
constitucional pero la imitación de la propiedad y de intervención la
lleva a cabo la ley específica con la remisión a los planes urbanísticos.
