De ABC bank wil aantonen dat de bowlingbanen onder het hypotheekrecht vallen. Ook
heeft de ABC bank nog pandrechten erop.
Wat is de positie van de fiscus?
1) Art. 21 Invorderingswet > Hierdoor heeft de fiscus een voorrecht op alle goederen
van de belastingschuldige.
2) Art. 3:279 BW > pand en hypotheek gaan boven voorrecht, tenzij de wet anders
bepaalt.
Hypotheekrechten gaat ten alle tijden voor de fiscus, maar bij sommige pandrechten
geldt een uitzondering:
3) Art. 21 lid 2 Invorderingswet > voor een specifiek geval van pand gaat de fiscus voor;
bij stil pandrecht op bodemzaken indien (lid 2):
Als we weten wat bodemzaken zijn in de zin van art. 22 lid 3 Invorderingswet, kunnen
we de rangorde uitmaken. Dan moeten we terug naar art. 21 lid 2. Daarin staat dat in de
gevallen van het derde lid art. 22 Invorderingswet de fiscus voor het pandrecht gaat.
Dan zie je dus ook wat in de inzet is van de procedure. De ABC bank heeft sowieso een
zekerheidsrecht op die bowlingbaan. Het is van belang om te weten of het een pandrecht
of een hypotheekrecht voor de rangorde. Als die bowlingbanen niet natrekken met de
grond, zijn ze hoe dan ook bodemzaken (want ze zijn duurzaam daar aanwezig) > dan
gaat de fiscus voor de pandhouder. Als ze wel natrekken, vallen ze onder het
hypotheekrecht (want dat rust op de grond en al haar bestanddelen) > dan gaat de ABC
bank voor.
Hoe kom je er achter of de bowlingbaan natrekt met de grond?
1) Depex-arrest > is het een bestanddeel in de zin van art. 3:4 BW?
a. Incompleet zonder? (Is het gebouw afgestemd op de machine?)
b. Constructieve afstemming? (Is de machine afgestemd op het gebouw?)
De Dépex-norm maakt apparatuur apart financierbaar, bv door eigendoms-
voorbehoud of pandrecht etc.
2) Portacabin-arrest > eigendom onroerende zaken via art. 3:3 jo. 5:20 BW
a. Naar aard en inrichting bestemd om duurzaam ter plaatse te blijven
b. Bedoeling van de bouwer voor zover naar buiten kenbaar
c. Bestemming gebouw dient voor derden kenbaar te zijn
d. Verkeersopvattingen
