1. What dynamics influenced the creation of the Justice and Home Affairs (JHA) pillar
during the Maastricht Treaty negotiations?
Justice and Home Affairs, third pillar in Maastricht. It was intergovernmental, just as
the second one. The first pillar was community. So this is where we came from. JHA
must have been something high politics, because they didn’t give up sovereignty. It
was in 1992, before there was the fall of the Berlin wall which ended communism.
JHA could probably not tackle the problems that would come up with all these

recognized relevance of JHA. Problem of criminality had to be tackled before
enlargement, because they knew that it came from the enlargement and once they’re

asylum policy to the first pillar, so to the community method, the supranational. So
movement towards supranational.Lisbon: three pillar structure was abolished and
they were all introduced into the AFSJ.
2. What are the key institutional reforms to JHA introduced by the 2009 Lisbon Treaty?
Emergency break was introduced. UK and Denmark opt out of the PCHM. Charter of
Human rights became legally binding.
3. What are the key policy activities associated with the Area of Freedom, Security and
Justice (AFSJ)?
Free movement, common immigration and asylum policy was the most important one
how to deall with that. Judical cooperation, fighting terrorism was also important.
4. Schengen area (Ireland and UK, Croatia, Cyprus, Bulgaria, Romania) is an
agreement where internal border controls are abolished, it is easier for refugees to
get to other European countries as there is no controls, once they are in, they can
travel almost anywhere and they can choose to enter the country where the
conditions are the least strict. Switzerland, Norway, Iceland, Liechtenstein are no EU
members but they are part of Schengen.
5. Dublin convention tried to prevent Asylum shopping by stopping them from making
more than one application at a time to enter Europe. This became necessary
