TÍTULO VI – Poder Judicial (Arts. 117-127)Art. 117: Conceptos generales
1. Justicia:
- Emana del pueblo
- Se administra en nombre del Rey por → Jueces + Magistrados
- Son: independientes, inamovibles, responsables, sometidos solo al imperio de
la ley.
2. Jueces y Magistrados → NO separados/suspendidos/trasladados/jubilados: SINO
por alguna de las causas y con las garantías previstas en la ley.
3. POTESTAD JURISDICCIONAL: juzgando y haciendo ejecutar lo juzgado → Juzgados
+ Tribunales.
4. No ejercer más funciones que las anteriores y las que marque la ley.
5. PRINCIPIO DE UNIDAD JURISDICCIONAL → base organización y funcionamiento de
los Tribunales.
Ley → regula del ejercicio de la jurisdicción militar (ámb. estrictamente castrense y
casos de estado de sitio).
6. Prohibición → Tribunales de excepción (diferencia con los de Honor).
Art. 118: Obligación de colaborar
Obligación:
- Cumplir sentencias y demás resoluciones firmes.
- Prestar colaboración requerida en el proceso y ejecución de lo resuelto.
Art. 119: Gratuidad
Gratuita cuando:
- Lo disponga la ley.
- Quienes acrediten insuficiencia recursos para litigar.
Art. 120: Publicidad
1. Actuaciones judiciales → PÚBLICAS: salvo excepciones previstas en las leyes de
procedimiento.
2. Procedimiento: predominantemente ORAL (sobre todo en materia criminal).
3. Sentencias: siempre MOTIVADAS, pronunciadas en audiencia pública.
