Kim Priemel: The Betrayal
- Priemel omschrijft overgangsjustitie als iets wat democratische verandering laat
zien en wat verbonden is met ideeën over mensenrechten.
- Benadrukt dat wet/recht en geschiedenis naast elkaar bestaan, maar elkaar
negeren. Zij zouden elkaar moeten erkennen.
Lawrence Douglas: The Didactic Trial
- Doelen didactische rechtszaken:
● Een gedetailleerd en nauwkeurig verhaal van historische gebeurtenissen
geven.
● ‘Het geven van geschiedenislessen’ om zo een collectieve herinnering te
vormen.
● Om de slachtoffers te herdenken en stil te staan bij de overlevers.
→ En hun publiekelijk rechtvaardigheid te geven.
⇒ Dus: ‘’The didactic trial thus aims to do justice not only to the accuses, but
to history and memory as well.’’
- Benadrukt dat men in Neurenberg vooral van hard bewijs gebruik maakte
(documentatie etc.) en dus de realiteit van de geschiedenis meer
kwijtraakte.
→ In tegenstelling tot Eichmann trial, waar juist wel veel ‘emotioneel
bewijs’ (getuigenissen). Ook al had men hier wel voldoende hard bewijs,
maar dan zou de rechtszaak zijn didactische functie verliezen.
- Douglas beschrijft verschillende filters ‘of how history and memory are moved into
the courtroom’:
● Politiek-historische context.
→ Bv. NATO-misdaden die niet werden berecht in ICTY.
● De regels van bewijsvoering: welk bewijs wordt er/mag er worden gebruikt?
● Strafbaarstelling waarvoor aangeklaagde veroordeeld.
→ Bv. BRD-genocide-misdadigers werden in Frankfurt slechts
veroordeeld tot ‘moord’ (want er was sprake van wettelijke
tegenstrijdigheid/involledighed)
● ‘’Principles of criminal accountability’’: principes van samenzwering of
‘Joint Criminal Enterprise’. Als men kan bewijzen dat een individu meewerkte
aan een gemeenschappelijk plan, kan dit individu aangeklaagd worden voor
misdaden die hij zelf wellicht niet heeft verricht.
● Ruimte: de rechtszaal en geografische locatie van rechtszaak hebben ook
effect op culturele herinnering en kennis van rechters.
● Tijd: hoe lang duurt het voordat aangeklaagde veroordeeld?
→ Soms kon het bv. wel 60 jaar duren voordat aangeklaagde
veroordeeld. Dit was dan meer een symbolische veroordeling voor
slachtoffers. Bovendien bekrachtigt het de macht van rechtbanken
en leert het de maatschappij over ‘the historical legacy of events’
