Opzet en voorbedachte raadVoorwaardelijke opzet:
➔ Opzet = willens en wetens handelen
➔ Voorwaardelijke opzet = willens en wetens de aanmerkelijke kans aanvaarden
Uitleg aanmerkelijke kans = HR r.o. 3.6 HIV I
● Aanmerkelijke kans = aard gedraging, omstandigheden van het het geval en
algemene ervaringsregels.
● Aanmerkelijkheid van de kans is niet afhankelijk van de aard (ernst) van het gevolg.
● De verdachte moet de aanmerkelijke kans op het gevolg ook bewust aanvaarden
○ dit kan blijken uit verklaringen of uit de uiterlijke verschijningsvorm van
gedragingen
Bij de arresten ‘schieten op raam’ moet objectief worden gekeken naar de aanmerkelijke
kans? Hoe groot is de kans dat het slachtoffer echt werd geraakt?
Als iemand te goeder trouw handelt, kan diegene niet voldoen aan voorwaardelijke opzet.
→ daar moet je te kwader trouw voor zijn.
Voorbedachte raad:
Voorbedachte raad = strafverzwarende bepaling
Voor 2012 was de HR niet zo streng met het vaststellen van voorbedachte raad
➔ arrest Voorbedachte raad I
Vanaf 2012 was de HR strenger
➔ arrest Voorbedachte raad II
Criterium voorbedachte raad:
● de verdachte heeft zich enige tijd kunnen beraden op het te nemen of het genomen
besluit
● de verdachte heeft NIET gehandeld in een ogenblikkelijke gemoedsopwelling
gehandeld
● hij heeft daardoor de gelegenheid gehad na te denken over de betekenis en de
gevolgen van zijn daad en zich daarvan rekenschap te geven
Contra-indicaties:
● plotselinge hevige drift
● korte tijdsspanne tussen besluit en uitvoering
● gelegenheid tot beraad pas tijdens uitvoering besluit
