D1 Assess the benefits and potential difficulties of upholding service users
rights in health and social care.
Negative case study _ a pupil with cerebral palsy who is a wheelchair user is told she
will be unable to attend a school trip to a local theatre putting on a production of a play she
is currently studying in English, because the building is nor wheelchair accessible. The pupil
and her parents are aware that the ply is also on at a theatre in a neighbouring city which is
accessible but the school not investigate this option. This is likely to be direct discrimination
because of disability.
Actually there are so many negative rule against the human right for example as student in
class have their right to be involving with class but this is not happening all the times which
mean some people still discriminating his needs also made him to feel less and unhappy
which is unfair. Everything always it is not happing as we saying or writing depending how
we understand each other need and rights also follow the right things. The teacher or youth
by doing make the student to feel less about his self and increase more health problems also
lose of self-esteem and self-image as well. The person who organised the activity or day out
with other students without only with the student needs against the person is rights which
mean they didn’t offer anything or change the place to go somewhere else take care worker
to support the student specially without doing anything and saying the student unable to
come it is quite hurtful. There are not benefits for the student or teach and youth worker. As
worker or teacher must think about everyone not only one. All they should know the law is
rules and understand everybody have their own rights without any difference. They should
be involve any activities without discriminating. Also doing everything to make sure the
student happy to join without fear or uncomfortable feeling. The way everyone is the same
can make family-friends happy also student and teachers or youth worker as well which
show we all the same and equal. It is really important when human rights are not protected
in law, they are always in danger of being eroded. A human right act would provide a
safeguard so that our politicians can’t simply overlook human rights considerations when
making laws that is why it important every employment know about those rules and
following them as well with people or worker.
Positive case study- Dora and Simon had been married for 59 years. Dora as blind and
had recently developed Alzheimer’s. She and Simon were injured in a fall at home, and
Simon was no longer able to care for her while he recovered. During this time, Dora was
moved into a local publically funded nursing home. It became clear that Dora would have to
stay in nursing home, but Simon visited her every day. However, their relationship was
threatened when the local authority decided to move Dora into a permanent nursing home
that was too far away for Simon and their children to visit. Simon contacted counsel and
care. They helped Simon to challenge the decision to move Dora on the basis that his and
Dora is right to family life.
The right was threatened by the move and the local authority needed to cosier this right hen
making their decision. This helped Simon to persuade social services to allow Dora to rein in
the nursing home close to her family and to Simon. He had right to ask and had help as well.
The right been success which helped both couple and moving house made everything easer
