Kwalificatie van de overeenkomst

Kan een stageovereenkomst worden gekwalificeerd als aovk?

Indien de bedoeling (en uitvoering!) van partijen er hoofdzakelijk op gericht is dat de
activiteiten van de werkende ten doel heeft het uitbreiden van eigen kennis en ervaring,
kan niet worden geoordeeld dat sprake is van een aovk

ABN AMRO Bank N.V./Malhi
Uitzendovereenkomst kan niet stilzwijgend wijzigen in een aovk
→ De rechtszekerheid verzet zich tegen stilzwijgende wijziging vd aard van ovk’s

STR = Stichting Thuiszorg Rotterdam

Het is niet van belang of partijen zelf procederen over of sprake is van een aovk, ook derden
(bv. pensioenfondsen) kunnen procedure starten

De Gouden Kooi
Ging om een deelnemer aan een spelshow, met de vraag of sprake was van een aovk
→ Alle omstandigheden van het geval moeten worden meegenomen in de
beoordeling, dus ook de feitelijke uitvoering en niet slechts wat partijen
bedoeld/gewenst hebben

I.c. was sprake van een aovk:
- Talpa gaf de deelnemer instructies (gezag)
→ Hierbij is van belang dat het deelnemers niet vrij stond de villa waarin zijn
zaten te verlaten
- Er was sprake van arbeid (arbeid)
- Deelnemer kreeg betaald voor de deelname (loon)

Groen/Schoevers
Voor het bepalen of sprake is van een aovk, is zowel bepalend wat partijen bij het sluiten
van de overeenkomst voor ogen stond, waarbij de wijze waarop feitelijk uitvoering en dus
daaraan inhoud is gegeven belangrijk is
→ Beide spelen dus een rol bij de kwalificatievraag (maar zie X/Amsterdam)
