Verschil volkssoevereiniteit en nationale soevereiniteit:
Bij volkssoevereiniteit besturen de burgers zichzelf
Nationale soevereiniteit: uitoefening door de verkozenen des volks
(volksvertegenwoordigers)
Enkel bij VKN ministeriële verantwoordelijkheid tegenover de Koning
Liberale eisten
Communautaire breuklijn (p.57):
Conflict rond de taal
Bediend in eigen taal (ook Nederlands), komt verandering in bij het Franse regime
Schaffen het oude gewoonterecht af (maken Code Napoleon)
Opeens zijn alle juridische termen in het Frans; wij worden een tijd bestuurd door Fransen
(Parijs)
Een deel vh verzet tegen Willem I is ingezet door Fransen
Taal is sociaal (taal duidt aan tot welke rang in de maatschappij je behoort)
Toplaag vd maatschappij sprak frans, omdat zij officiële posities innemen, contracten
aanmaken etc.
1831: Frans als standaardtaal om het land te besturen (Waalse dialecten etc. zijn ook enkel
dialecten niet mee officieel)
Op dit moment is er geen Vlaamse, Nederlandse partij ih parlement
Hendrik Conscience: Fransman die in het Nederlands begint te schrijven, wordt door de
Vlaamse beweging gezien als één vd voorlopers van de latere grotere bewegingen
Koning ziet ook dat als Frans zo belangrijk wordt en blijft, gaan anderen België simpelweg
zien als pop van de Fransen
Voorgeschiedenis:
Nederlands was ook een bestuurstaal
Franse periode: elites, magistraten, advocaten etc. gaan ook naar Frans overschakelen
Revolutionairen gebruiken het frans (sociaal: zitten bij topklassen of willen erbij horen)
1830: liberalen prefereren Frans (meer emancipatie, verlichting etc. kunnen zo meer
boeken erover lezen etc.)
Katholieken: belangrijke politici zijn Franstalig
Overheid mag de magistraat niet verplichten Nederlands te spreken (zoals Willem I); gebruik
van in België bestaande talen is vrij (grondwet)
Kan enkel door de wet geregeld worden (door zij die kunnen stemmen)
Wet eisen op gebruik van taal (op bestuurszaken: benoeming van ambtenaren etc.)
