Basic Conditions of Employment Act
(BCEA)

- This legislation document intends:

- To give effect to the right to fair labour practices referred to in section 23(1) of
the Constitution by establishing and making provision for the regulation of
basic conditions of employment

- Thereby to comply with the obligations of the Republic as a member state of
the International Labour Organisation

- To provide for matters connected therewith

- The Act applies to all employees (EEs) and employers (ERs) except:
- Members of the SANDF, National Intelligence Agency, South African Secret
Service; and
- Unpaid volunteers working for an organisation with a charitable purpose


Regulation of Working Time

- The maximum working time allowed is 45 hours weekly
- 9 hours per day (excluding lunch break) if employee works a 5-day week, and
8 hours per day (excluding lunch break) if employee works more than 5 days
a week

- An EE’s ordinary hours may, by agreement, be extended by 15 minutes in a day, but
not more than 1 hour in a week (overtime)

Overtime

- Only EEs who earn below the threshold are eligible for overtime

- The current threshold is R241,110 per annum, thus if one earns above
R20,092 per month, they are not eligible for overtime

- Overtime is calculated at 1.5x your salary eg. if you earn R100/hour and you work 1
hour overtime, you will earn R150/hour for overtime

- For overtime on a public holiday and Sunday, an employee will earn double their rate
eg. R200/hour
