COMIENZO: NACIMIENTO.Para las personas físicas o individuales el nacimiento es el momento que determina la
personalidad. A partir de ese momento es apto para ser titular de derechos y
obligaciones.
1. Condiciones del nacimiento.
Trata de asegurar que a los seres a los que se les otorga capacidad reúnan una serie de
requisitos que les permita ser aptos para ostentar derechos y obligaciones.
2. Concebidos y aun no nacidos.
El nacimiento determina la personalidad; pero el concebido se tiene por nacido para
todos los efectos que le sean favorables, siempre que nazca con las condiciones que
expresa el artículo 30 del Código Civil.
3. Reserva de derechos a favor de no concebidos.
Personas aún no concebidas: “concepturus”.
Asunto que generalmente se trata en materia de sucesiones.
A veces se designa a esa persona aún por concebir como heredero.
4. Partos múltiples.
En estos casos el título de heredero se lo lleva el primer nacido, es decir, el primogénito.
