Unit 3
Outline how legislation, policies and procedures relating to health,
safety and security infuence health and social care settings (P2)
Describe how health and safety legislation, policies and procedures
promote the safety of individuals in a health or social care setting
(M1)
I am going to begin by addressing the mere diference between legislations
and policies & procedures. Legislations are a part of law, which must be
followed by the entire country. Whereas policies and procedures can be
followed by diferent organisations.
Beginning with legislations there has been a range specifcally aimed at
health and safety. The Health and Safety at Work act was passed in 1974.
This improved the standard of health and safety at work and also reduced the
risk of accidents and injuries in a work place. (2) However overall this act
covers a lot of things including the reporting of accidents/ incidents which is
helpful as it helps minimalize risks and so eventually they can be avoided,
also having it reported can help to see the trend of accidents and see if they
can be prevented. Additionally the act covers training and providing safety
equipment. It ensures that the employers are responsible for everyone on
premises. This act promotes safety over individuals as it puts them in a
completely liable position if not doing something correctly. This can apply to
Riverglade as there is many hazards that can put residents at risk of
accidents e.g. leaving those with dementia around safety signs they have no
longer remember and a hoover chord on the foor around those with arthritis.
Moreover the Manual Handling Operations Regulations was passed in 1992.
This act is based on "any transporting or supporting of a load (including the
lifting, putting down, pushing, pulling, carrying or moving thereof) by hand or
bodily force". It is recommended that you try to avoid this unless you have
the required training. This can be applied to Riverglade as it was stated that
sometimes those recovering strokes have been put into the situation of
bathing alone. Whether this is due to a lack of skill in manual handling or not
enough staf, I am not informed.
Further RIDDOR (reporting of injuries, diseases, and dangerous occurrences
regulations), passed in 1995 means that if you contain any of these, you
should be sure to let your local council know. Another abbreviation is COSHH
(control of substances hazardous to health) it promotes safety as plans are
put in place to deal with accidents and emergencies therefore it puts
individuals at ease as they know a policy is in place, it also promotes safety
as all hazardous substances have been risk assessed with policies and
procedures put in place to contain them.
Data protection act is the storing of current and accurate information (cannot
hold onto it for too long) however death records can be retained up to 8 years
after death and maternity records must be kept until 25 years of age.
